Lower Nazareth Wins Trash Dispute with Selvaggio

Lower Nazareth Township solicitor tells supervisors that judge ruled Selvaggio Enterprises is responsible for trash removal at foreclosed property.

In the latest skirmish between Lower Nazareth Township and Selvaggio Enterprises, a Northampton County judge ruled for the township in a dispute over who has to take out the trash.

The township bought the foreclosed Selvaggio property at 623 Selvaggio Drive in January and has filed to evict the former owners. The township plans to move its municipal offices into the building.

Township Solicitor Gary Asteak updated the board on the case at Wednesday’s meeting, saying that Northampton County Judge Craig Dally had ruled that Selvaggio is still responsible for trash removal from the property.

The township has been caught in a tug of war with Selvaggio Enterprises Inc. since the township bought the property, which had been foreclosed on in July 2010.

The address, 623 Selvaggio Drive, will be renamed 623 Municipal Drive as of Nov. 1 and will house the township municipal offices and, possibly, a public works office and a community center, according to township officials. Part of the land might be turned into a park.

According to a report in The Morning Call, a series of six lawsuits was filed in February to evict Stephen and Teresa Selvaggio, Selvaggio Enterprises Inc., Selvaggio Plumbing and Heating, Selvaggio Excavating Inc., Selvaggio and Sons Plumbing and Heating, and Newburg Plumbing Supply Inc.

At last week's supervisors meeting, Asteak said the case could be scheduled for trial in October. “The Selvaggio litigation is moving along,” he said. 

Selvaggio, according to a report in The Express Times, had filed a “petition for special relief” against the township, requesting that the township be responsible for outdoor trash removal at the property. It was on that petition that the judge sided with the township.
